National Make a Will month: A Loving Gift

Most of us spend years building a life we cherish—a home filled with memories, relationships we treasure, and resources we hope will benefit those we love. Yet surveys estimate over 55% of families are left with unnecessary stress because an estate plan was never completed or updated. National Make-A-Will Month is an excellent reminder to put your wishes in writing. While it may not be the most exciting item on your to-do list, creating a will is one of the greatest gifts you can leave your loved ones.

What Is a Will? 

A will is a legal document that outlines how you want your assets distributed after your death. It can also name guardians for minor children and designate an executor to carry out your wishes. Without a valid will, state law determines how your estate is divided, which may not reflect your personal wishes. 

A will might be a better choice if: 

  • Have a relatively simple estate 
  • Are comfortable with the probate process 
  • Primarily want to name guardians for minor children 
  • Are looking for a lower-cost estate planning option 

However, if you own significant or multiple assets, want to avoid probate and its public records, have properties in more than one state, have a blended family or a family member with special needs who requires ongoing care, want more control over when and how beneficiaries receive their inheritance, or want to privately create a charitable or family legacy, a living trust may be a better choice. 

Choosing the Right Estate Planning Professional 

Look for an attorney whose practice focuses on estate planning rather than someone who prepares wills only occasionally. Ask friends, your financial advisor, accountant, or other trusted professionals for recommendations. Choose someone who takes the time to understand your family, financial goals, and personal values, explains your options clearly, and answers your questions thoroughly. 

Preparing for Your First Meeting 

Before meeting with an estate planning professional, spend some time thinking about your goals and gathering important information. Consider questions such as: 

  • Who should inherit your assets? 
  • Would you like to include grandchildren in your estate plan? 
  • Is there a charity or ministry you would like to support through a legacy gift? 
  • Who would be the best choice to serve as your executor? 
  • If you became unable to manage your affairs, who would you trust to make financial or health care decisions on your behalf? 
  • Are there family heirlooms or sentimental items you want to leave to specific people? 
  • Are all of your beneficiary designations on retirement accounts and insurance policies current? 

It is also helpful to bring a list of your assets, debts, insurance policies, retirement accounts, real estate holdings, and any previous estate planning documents to your appointment. 

Remember to update your will if there have been changes in your family, estate, or estate tax laws, or if you have moved to another state. Even if nothing significant has changed, it’s wise to have your estate planning documents reviewed every three to five years to ensure they still reflect your wishes and comply with current laws.

It can be helpful to think of creating a will as a way of caring for the people and charities you love. This perspective can be motivating to have one prepared. It provides clarity during a difficult time, helps reduce family stress, and gives you the peace of mind that your wishes will be honored.
